1. Acceptance of Terms
By creating an account on or using the OursYours platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. These Terms constitute a legally binding agreement between you and OursYours Pty Ltd ("OursYours", "we", "us").
2. Platform Description
OursYours is property ownership infrastructure. It coordinates demand for property ownership through two pathways: Own Together (Ours) for collective, debt-free ownership via unit trusts, and Own Your Way (Yours) for private deal structuring. OursYours is not a real estate agent, financial adviser, fund manager, lender, or custodian. The Platform does not provide financial, legal, or tax advice.
3. Eligibility
You must be at least 18 years old and a resident of Australia to use the Platform. By registering, you represent that you meet these requirements. Certain features may require additional eligibility criteria (e.g. qualified investor status for wholesale trusts).
4. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials. You must enable multi-factor authentication as required by the Platform. You agree to notify us immediately of any unauthorised use of your account. You must not share your account or impersonate another user.
5. Ownership Participation
Participation in property ownership (Ours pathway) is subject to: minimum 5% stake requirement; maximum ownership caps (15% for private unit trusts, 40% for wholesale unit trusts); 14-day cooling-off period for retail participants; and resale via First Right of Refusal (FROR) before open market listing. Funding commitments are binding once confirmed and settlement is initiated.
6. Professional Services
Professionals (solicitors, conveyancers, property managers, accountants) who register on the Platform must maintain valid licences and professional indemnity insurance. A 5% platform service fee applies to contractor marketplace transactions. All professional communications must be conducted through the Platform.
7. Prohibited Conduct
You must not: use the Platform for unlawful purposes; attempt to circumvent security measures; interfere with other users' access; scrape, crawl, or automatically extract data; conduct off-platform transactions that originated on the Platform; or submit false or misleading information.
8. Intellectual Property
All Platform content, design, code, and trademarks are owned by OursYours. You retain ownership of content you upload but grant us a licence to use it for Platform operations. The OY Identifier Standard and associated formats are proprietary to OursYours.
9. Limitation of Liability
To the maximum extent permitted by law, OursYours is not liable for: any loss arising from property ownership decisions; inaccuracies in third-party data (Domain API, NSW Strata Hub); actions or omissions of professionals coordinated through the Platform; or any indirect, consequential, or punitive damages. Nothing in these Terms excludes liability that cannot be excluded under Australian Consumer Law.
10. Dispute Resolution
Any dispute arising from these Terms must first be submitted through the Platform's feedback system. If unresolved within 30 days, disputes shall be referred to mediation under the Resolution Institute's rules. These Terms are governed by the laws of New South Wales, Australia.
11. Termination
We may suspend or terminate your account if you breach these Terms. You may request account deletion through Settings, subject to completion of any outstanding transactions and legal retention obligations. Upon termination, your access to the Platform will cease but audit records will be retained as required by law.
12. Changes to Terms
We may modify these Terms at any time. Material changes will be notified via the Platform at least 14 days before taking effect. Continued use after changes constitutes acceptance.
